Cremains customers (human or pet) follow the same USPS regulations and shipping process. Frozen pet customers follow a separate process involving overnight carriers.

1. CREMAINS INBOUND (Customer Ships Human or Pet Cremains TO Facility)
This section applies to both human and pet cremains. The customer is shipping cremains to Legacy Soil & Stone for incorporation into a memorial stone.
Regulatory Framework
USPS Publication 52 governs the mailing of cremated remains. As of March 1, 2025, updated rules apply:
- Carrier Restriction: Cremated remains (human or animal) may only be shipped via USPS Priority Mail Express. No other USPS service class is permitted.
- FedEx, UPS, DHL: Do not accept cremated remains for shipment -- human or pet. USPS is the only domestic carrier option.
- Mandatory Packaging: Mailers must use the USPS-provided BOX-CRE (Cremated Remains Box). Custom packaging is no longer permitted. The previous option of affixing Label 139 to any box was eliminated.

Human Cremains vs. Pet Cremains
The USPS rules are identical. There is no distinction between human and pet cremains in the shipping regulations:
- Same Priority Mail Express requirement
- Same BOX-CRE mandatory packaging
- Same regulations apply to ashes, keepsake jewelry containing ashes, and any other form of cremated remains
- No exemptions or different handling for pet ashes vs. human ashes

Can the Business Send a Shipping Kit to the Customer?
Yes. The practical approach is to send the customer everything they need. Here is what Legacy Soil & Stone would send:
- USPS BOX-CRE Kit 2 (ordered free from USPS Postal Store in bulk)
- A prepaid Priority Mail Express shipping label (generated via USPS Click-N-Ship or Pirate Ship)
- Simple instruction card (1-page, branded) explaining:
- Place cremains in the sealed plastic bag provided - Wrap with bubble cushioning - Place in the BOX-CRE box - Seal with PME tape - Affix the prepaid label - Drop at any Post Office or schedule a pickup
- A branded outer mailer to ship the kit to the customer (standard Priority Mail or Ground Advantage)
Shipping the kit to the customer: ~$8-12 via USPS Ground Advantage or Priority Mail (the box folds flat, so it ships cheaply outbound).

Cremains weight varies. Pet cremains for a typical cat or small-to-medium dog weigh 1-5 lbs. Human cremains (a partial amount sent for a memorial stone) will typically weigh 1-3 lbs. The BOX-CRE box itself adds minimal weight.

Packaging Requirements
Essential packaging layers (inside to outside):
- Inner containment: Pet placed in a heavy-duty leak-proof plastic bag (zipper-lock freezer bag or sealed poly bag). Remove as much air as possible. Tape shut.
- Second barrier: Place first bag inside a second leak-proof bag with absorbent material (disposable diapers, absorbent pads) between layers. Tape shut.
- Cold source: Gel ice packs OR dry ice placed around the bagged animal. For overnight shipping without dry ice, frozen gel packs are sufficient IF the pet is deeply frozen beforehand.
- Insulated container: Styrofoam cooler (EPS foam box) -- the kind used for Omaha Steaks, meal kits, etc. Available at hardware stores, restaurant supply stores, or online.
- Outer box: Corrugated cardboard shipping box that fits snugly around the Styrofoam cooler. Seal with packing tape.
Critical rules:
- The package MUST NOT leak. Leaking packages can be confiscated and destroyed, with fines possible.
- If using dry ice: package must be vented (not airtight), marked with "DRY ICE" / "CARBON DIOXIDE, SOLID" / UN1845 / Class 9 hazmat diamond / net weight of dry ice

Note: For overnight FedEx shipping, frozen gel packs are the simpler choice. They avoid hazmat labeling requirements and are adequate for 24-hour transit if the pet is deep-frozen for at least 24 hours before packing. Dry ice may be necessary for 2-day shipments or very large animals.

Regulations on Shipping Animal Remains
Federal:
- No specific federal prohibition on shipping deceased pets via private carriers (FedEx/UPS)
- DOT regulations apply only to the dry ice component (49 CFR 173.217)
- If the animal died from a reportable/quarantinable disease, additional USDA APHIS Veterinary Services rules may apply -- but this is rare for household pets

State:
- Most states have no restrictions on receiving deceased animals for composting/cremation
- Georgia's own regulations for pet aftercare should be verified with the Georgia Department of Agriculture

Should You Send a Kit?

THE BIG QUESTION: USDA APHIS Regulations on Interstate Soil Movement
This section addresses the critical regulatory question: Can Legacy Soil & Stone legally ship finished compost soil across state lines?
What APHIS Says About "Soil"
APHIS defines soil as: "a mixture of inorganic and organic materials when the organic materials are unidentifiable plant and/or animal parts, and is the loose surface material of the earth which comprises the major medium for plant growth."
APHIS explicitly includes in its definition of soil: topsoil, forest litter, wood or plant compost, humus, and earthworm castings.
This means finished compost IS classified as "soil" under APHIS definitions -- it is not automatically exempt simply because it has been composted.

Interstate Movement of Domestic Soil
General Rule: Within the continental United States, interstate movement of domestic soil is restricted primarily when moving soil out of federal quarantine zones for specific plant pests.
This is NOT a blanket prohibition on all interstate soil movement. The restriction applies specifically to soil originating in areas under active quarantine.
CRITICAL FINDING: Georgia's Quarantine Status
Georgia is ENTIRELY within the Federal Imported Fire Ant (IFA) Quarantine Zone.
Under 7 CFR Part 301, Subpart P, the entire state of Georgia is quarantined for imported fire ants. This means:
- Soil is a regulated article under the IFA quarantine
- Moving soil out of Georgia to non-quarantined states requires either:
- Certification by state/federal inspectors that the soil is fire-ant free, OR - Approved treatment of the soil before shipment

Potential Exemption for Processed Compost
Under the IFA quarantine regulations, compost, decomposed manure, humus, and peat are EXEMPT from certification and permit requirements IF the material is:
- Dehydrated, OR
- Ground, OR
- Pulverized, OR
- Compressed
If Legacy Soil & Stone's finished compost meets any of these criteria (and well-cured compost that has been screened/sifted likely qualifies as "ground" or "pulverized"), it may be exempt from IFA quarantine certification requirements.

What About Shipping to Other Quarantined States?
Many of Legacy Soil & Stone's likely customer base states are ALSO in the IFA quarantine zone (Alabama, Florida, South Carolina, Tennessee (partial), North Carolina (partial), Mississippi, Louisiana, Texas (partial)). Movement of soil between two quarantined areas is generally NOT restricted under the IFA quarantine -- the restrictions apply only to movement OUT of the quarantine zone into non-quarantined areas.
This means shipping soil to customers in the Southeast (the most likely customer base) is likely unrestricted for fire ant purposes.
Soil Amendments vs. Raw Soil
APHIS also has a framework for "soil amendments" and "plant growth enhancers" (which includes fertilizers, compost, sludge, and other materials used to enhance plant growth). These are regulated under a separate framework focused primarily on imported materials, not domestic interstate movement.
Key distinction: The soil amendment/plant growth enhancer regulations under APHIS are primarily aimed at imports from foreign countries, not interstate movement within the continental U.S.

What Does Recompose (Human Composting) Do?
Recompose, the leading human composting company, ships soil to customers across the U.S. Their FAQ states: "We ship soil to most locations in the U.S." They package soil in durable paper bags (~12 gallons each, ~20 lbs each) and ship via standard carriers. They do not appear to require any special APHIS permits for domestic interstate shipment.
This suggests that finished compost can be shipped interstate within the continental U.S. without a PPQ 526 permit, though Recompose operates under Washington state regulations, not Georgia's. The precedent is worth noting but not directly transferable without verifying Georgia-specific requirements.

PPQ 525 and PPQ 526 Permits -- Do You Need Them?
- PPQ 525: Required for importing soil from foreign countries for analysis purposes. NOT applicable to Legacy Soil & Stone.
- PPQ 526: Required for importing or moving soil interstate that contains or may contain plant pests, OR for soil from Hawaii/U.S. territories. For continental U.S. domestic soil, this permit is only required when moving soil out of a quarantine zone (which Georgia is, for IFA).
Bottom line: If the finished compost qualifies for the dehydrated/ground/pulverized/compressed exemption under the IFA quarantine, no PPQ 526 permit should be required.
Practical Path Forward for Legacy Soil & Stone
- Verify the IFA exemption applies. Contact the Georgia Department of Agriculture and/or the APHIS State Plant Health Director for Georgia. Ask specifically: "Does finished, screened pet composting soil that has been cured for 90+ days at thermophilic temperatures qualify as 'ground or pulverized compost' exempt from IFA quarantine certification under 7 CFR 301.81?"
- Document your composting process. Maintain records showing:
- Time-temperature logs proving thermophilic composting (131+ F for 3+ days minimum) - Screening/sifting process (demonstrates the material is "ground" or "pulverized") - Pathogen testing results (fecal coliform, Salmonella) per EPA 40 CFR 503 standards - This documentation protects you even if questioned
- Consider pathogen-free certification. Having finished compost tested by a certified lab for pathogens (and documenting that it meets EPA Class A biosolids standards or equivalent) provides additional regulatory defense.
- Ship to quarantined states freely. For customers in GA, AL, FL, SC, MS, LA, and quarantined portions of NC, TN, TX, AR -- no IFA restrictions apply for soil movement between quarantined areas.
- For non-quarantined states: Ensure your compost meets the exemption criteria (screened/ground/pulverized), keep documentation, and ship normally. If any question arises, you have the thermophilic processing records and lab testing to demonstrate the product is safe.
- Alternative workaround -- Ship soil as a "product" not "soil." Some companies market finished compost as a "soil amendment," "growing medium," or "plant nutrition product" rather than "soil." While labeling alone doesn't change the regulatory classification, a product that has been commercially processed, screened, bagged, and sold as a consumer product is treated differently in practice than bulk raw soil.
